What is an administrative proceeding?

If you own a small business that is licensed or employs licensed professionals, you are likely familiar with the notion of an “administrative agency": it is the government agency that issues your license or oversees your industry. But administrative agencies do not exist solely to regulate licensed occupations: there are a plethora of government regulators that oversee almost every aspect of small, medium, and large businesses. From the United States Department of Labor, which oversees enforcement of federal labor laws, to city governments enforcing transaction privilege taxes, administrative agencies abound.

Ideally you will never come face-to-face with a regulator. In practice, however, whether a result of random audits or other reasons, you may receive correspondence, subpoenas, or other communications from an administrative agency. If so, it would be wise to consider retaining counsel, especially if you have never dealt with that particular agency in the past.
